Colorado legalized hemp alongside other states with the passage of SB 19-220 in 2019, and this technically included any cannabinoid in hemp provided the delta-9 was within the Farm Bill limit. However, in May 2021, the Department of Public Health and Environment and the Marijuana Enforcement Division clarified that “chemically modifying or converting any naturally-occurring cannabinoids from industrial hemp is non-compliant with the statutory definition of ‘industrial hemp product.’” In other words, any hemp delta-8 product and the majority of hemp delta-9 ones will be technically illegal because of this.
